By initiating a work-out or otherwise using a Jabra Product, you are acting voluntarily and at your own free will. Consequently, you are liable for all risks associated with such activities even if such risks may be claimed to be caused in whole or part by actions, inactions or negligence of Jabra, its affiliates, directors, officers, employees or others.

Jabra, its affiliates, directors, officers or employees will not perform and is not responsible for any physical inspection, supervision, preparation, execution or conduct of any activities related to use of the Jabra Products.

The Jabra Products are not intended to provide or be relied upon as medical advice on physical activity. The Jabra Products may include features that promote physical activity or enable different kinds of tests, training in different types of training zones, adding heart rate settings and/or other personal values related to physical activities. By using the various services of the Jabra Products, you understand and agree that Jabra does not provide any form of medical advice through the services of the Jabra Products nor does Jabra intent to operate or guide you in terms of medical information regarding your physical activity. You need to carefully consider the risks involved before and when using the Jabra Products and you are advised to consult with your doctor or other physician before engaging in any physical activity. Jabra, its affiliates, directors, officers or employees are not responsible or liable for any injuries or damages you may sustain that result from your use of, or inability to use, the services offered through the Jabra Products, including as a result of any delay or negligence in seeking medical advice from your doctor or other physician. Note that in addition to training intensity, medication for heart conditions/blood pressure/psychological conditions/asthma/breathing etc., as well as some energy drinks, alcohol, and nicotine may also affect heart rate. If you have a pacemaker, defibrillator or other implanted electronic device, please note that there may be implications by using the Jabra Products and consequently you do so at your own risk.

The Jabra Products and the services provided by the Jabra Products are provided "As Is" without any express or implied warranties of any kind and Jabra disclaims all warranties to the fullest extent permitted by applicable law, whether written or oral, express or implied, including, but not limited to, warranties of title, merchantability, fitness for a particular purpose and non-infringement. Furthermore, Jabra does not warrant or make any warranty or representation as to the use of the services provided by the Jabra Products in terms of correctness, accuracy, adequacy, usefulness, reliability, availability, security, safety or otherwise. Jabra does not guarantee that use of the services provided by the Jabra Products will be timely, uninterrupted, secure or error-free and Jabra, its affiliates, directors, officers or employees shall not be subject to liability for the truth, accuracy, or completeness of any information conveyed to users or for errors, mistakes or omissions therein or for any delays or interruptions of the data or information from whatever cause.

In no event will Jabra or its subsidiaries, affiliates, directors, officers or employees be liable for any consequential, indirect, incidental, exemplary, special or punitive damages, including lost data, whether in contract, tort or otherwise, even if Jabra was or should have been aware of the possibility of these damages, arising out of or related to the use, or inability to use, any of the services provided by the Jabra Products. Any use of the services provided by the Jabra Products is at your own risk.

Applicable law may not allow exclusions or limitations of certain warranties and/or liabilities however you agree to that the foregoing disclaimers shall apply to the widest extent permitted by applicable law.

Jabra may amend, modify, supplement and/or terminate any of the services provided by the Jabra Products at any time without notice.

RELEASE AND INDEMNITY

You agree to release Jabra and its subsidiaries, affiliates, directors, officers and employees from any and all liability related to your physical activities and shall not sue Jabra or its subsidiaries, affiliates, directors, officers and employees for any injuries, damages or other losses suffered or otherwise incurred as a result of your physical activities. You further agree to indemnify, defend, and hold harmless Jabra and its subsidiaries, affiliates, directors, officers and employees from and against any and all claims, losses, liabilities, expenses, damages, and costs, including, without limitation, attorneys' fees, arising from or relating in any way to your use of the Jabra Products and the services provided by the Jabra Products and your conduct in connection with the use of the Jabra Products and the services provided by the Jabra Products or any violation of these terms and conditions, any applicable law or the rights of any third party.
